1 The goal of this assignment is to define when corporate assets may be considered intellectual property (IP), examine when IP theft has happened and possible remedies, and evaluate the value of safeguarding and enforcing IP rights in a business setting.
2 Read the scenario below. Futuretek is a company that supplies high-tech computer chips and software to smartphone makers all around the world. Futuretek keeps two software databases: one with the company’s client list and nonpublic contact information for key staff, and the other with customer purchasing habits. Employees can examine and use the information in the two databases as part of their work responsibilities. Dana works for Futuretek as a computer programmer. Dana hopes to one day operate her own business, designing and selling computer chips to smartphone manufacturers. She has access to two databases including Futuretek’s major purchaser and purchasing trends data as an employee. Dana makes the decision to leave Futuretek and launch her own computer chip company. She copies the two databases onto a portable hard drive before she leaves. Dana utilizes the information to contact Futuretek’s clients and sell them SmartChip’s cheaper but comparable computer chips. When Futuretek learns of Dana’s conduct, it turns to you, the chief operating officer, for guidance and recommendations.
