The Daredevil’s Case is a true story of a daredevil.The SituationEvel Knievel was a motorcycle stuntman who earned a worldwide reputation for his audacious stunts over the course of decades. He flew over rattlesnakes, broke world records for blasting over 14 parked buses, and spent 30 days in a coma after his 151-foot jump over Caesar’s Palace hotel’s fountains fell short by a few feet. His achievements were recognized by the Smithsonian Institute, and he established a strong reputation as a community organizer and advocate for young people, utilizing his celebrity to promote anti-drug initiatives and motorcycle safety.Many celebrities were seen at an ESPN awards ceremony celebrating victors in extreme sports (skateboarding, surfing, and motorbike racing). The network posted images from the event on its website, ESPN.com, including one of Knievel with his right arm around his wife, Krystal, and his left arm on a young woman. “Evel Knievel illustrates that you can never be too old to be a pimp,” the caption said.The Knievels filed a defamation suit, saying that the term “pimp” caused them to be hated, despised, and ridiculed, as well as causing some of Evel’s previous clients to cease working with him.The CaseAccording to the Plaintiff, the question is whether the material would be considered defamatory by reasonable viewers (and reasonable jurors).
