Mississippi and Delaware: Duty to Warn
For this assignment, students will research the states or regions they were assigned about the following issues.
What does “duty to warn” look like in your state, circumstances? Who does the “duty” apply to in your state? What are the circumstances where it applies? Is there a civil or criminal penalty for a “failure” to warn? How similar or dissimilar to the original Tarasoff duty are the relevant statutes in your 3 states?
Who has to be warned? If you can find an article that indicates where the state or region was in terms of the law at the time of Tarasoff and how that has changed ( if at all) that would be very interesting? Are there any “recent” cases in your state or region that further define the meaning and application of the relevant law?
Do not copy the law or quote the law verbatim. Paraphrase and use your own words. If the law is confusing, note that. Cite the applicable law.
These issues will require internet research beyond the state website and governmental official website that contains the actual language of the law, policy, regulation, etc.
Feel free to write about (and present) additional relevant (and interesting) information. Your written assignment should contain the majority of the information that you have found as a result of your research. However, you’re in-class informal presentation should only highlight those aspects that you found most interesting and should be no more than 5-8 minutes in length. You will lose credit for exceeding that time.
Your final credit points for this assignment will include both your presentation and your written summary.
Locate and describe “public” reaction to the administration of this law or policy. You may find evidence of a reaction in a news report, a public legislative controversy, or a public “outcry” through internet research please summarize the issues and how they were addressed. If you can find this for one of your assigned areas only, that would be sufficient. This response may be demonstrated by a public reaction or article promulgated by an organization such as the NAACP, ACLU, etc. or it may be demonstrated by an article, white paper, editorial, blog, or similar posting on social media.
If you can find can law review article about the specific statute (controversy, criticisms, analysis, etc.) through research using Lexis Nexus (check RWU librarians and webpage) please include your written summary of the relevance. Again, if you can find this for one of your assigned areas that would be sufficient
What is your “opinion” of the law in this case? Your answer to this question should be considered in terms of all of the examples that you were able to find in part I. Justify and support your opinion. No “one-liners”.
You may elect to do Parts I and II and IV or Parts I and III and IV based on what you find after your online research.
Hopefully, you will find information for your assigned states, regions, territories, etc. for Parts I through IV.
For parts II and III be sure that they are related to the specific law that you describe in Part I.
CAVEAT:
It is unlikely that you will find the same amount of information on all your designated states, unincorporated territories, Districts, or Presidential Republics on the assigned topic. Explain in your written summary how you conducted your search in those instances where no information was located.
