For organizations that distribute copyrighted material, there are two non-technical controls that can be taken. Firstly, management needs to ensure that they have received proper written permission (licenses) for any work they are distributing. Photographs, music, movies, and television programs are all items that require licenses to distribute. When obtaining a license, management should ensure that they are being properly reviewed to ensure the licenses “specifically identify the content to be used, how it is to be used, and how long it is to be used” (Barr, 2016).
Along with obtaining licenses to distribute the material, management needs to pay careful attention to any claims that their distributed material is violating copyright. Copyright claims can be extremely costly if not properly addressed with fines ranging from $200 to $150,000 per infringement and the cost of all attorney fees in the case, including the plaintiff (Copyright infringement policies, n.d.). Should a copyright violation claim be filed against the organization, the claim needs to be investigated quickly and the distribution of the materials needs to be halted immediately until the investigation is completed (Stim, 2016).
One of the risks with distributing copyrighted material comes from potential internal threats. Particularly with digital distributors like Spotify or Netflix, certain employees will have regular access to these materials as part of their daily operations. It would be very tempting and easy for users with access to those files to download them for personal use without purchasing them, which would violate most license agreements. To reduce the risk of this, least privilege can be enforced throughout the organization to ensure only employees with a business need to download and access copywritten materials have permission to do so. Additionally, tracking and monitoring all downloads within the organization can help identify any user attempting to download material that the organization is responsible for. Lastly, enforcing software policies that block or prevent the installation of unapproved filesharing programs like torrent or cloud storage applications will minimize the risk of employees downloading other material that can cause a copyright violation. These technical controls are one way that ethics can be enforced within the organization using software. Monitoring software that tracks downloads and imposing installation restrictions will reduce the ability for employees to violate a copyright license and will also alert the IT staff and management of their actions so proper training or disciplinary can be applied.
