Andy King is the proprietor of a small sandwich shop in Boca Raton, Florida. Andy The Burger King is the name of the restaurant, which has been open for about a month.
Andy sells standard “burger joint” fare such as hamburgers, chicken sandwiches, french fries, onion rings, sodas, and milkshakes. In honor of his Cuban ancestors (his mother was born in Havana), he also sells Cuban sandwiches in two sizes: “The Regular” and “The Whopper.”
Andy enjoys listening to music through his shop’s speaker system. In general, he listens to music that he has recently purchased on his own and downloaded to his iTunes account. Recently, his favorite album to play for his customers has been Imagine Dragons’ “Night Visions.”
Andy has two letters arrive in the mail. The first is from Burger King Corporation, which demands that he stop using the name of his restaurant as well as the name of the large Cuban sandwich. The second letter is from Broadcast Music, Inc., on behalf of Imagine Dragons, informing him that he must pay royalties to the band or stop playing the music. Both companies state that if no action is taken immediately, Andy will be sued.
What are the fundamentals of each potential lawsuit, what legal analysis (including the “elements” of each legal claim) could each plaintiff (Burger King and BMI/Imagine Dragons) use to make its case, what defenses could Andy use, and how do you think each case would be decided in court?
You will be graded based on your complete and correct explanations, research, and language usage, as detailed below. The report must be submitted typed and double-spaced. A report that does not adhere to this format will be deducted according to the grading rubric. This project accounts for 15% of your overall grade.
