Mastery of Course Goal #2 is assessed through this assignment. You have been assigned a healthcare related lawsuit and will practice critically reviewing using this case. This is a skill needed because the outcome of malpractice cases affects our practice. You will utilize these skills again when you conduct research for your final dilemma analysis paper.
You will complete this TEMPLATE for Legal Case Critique. The response column will expand in this word document as you develop your answer. Copy and paste the Attestation Statement to the cover page you create for your template. Answers are to be written exclusively in your own words; No quotations are allowed, including significant passages or sentences from the case. If this requirement is ignored the paper will be returned and a standard late penalty will be applied to any re-submission.
I encourage you to first skim the case, then read it a second time to focus on specific content. Please review this terminology document – Legal Terminology. You will probably need a free on-line legal dictionary, such as The Law Dictionary, as you read the case. Both are helpful to better understand what you read. You can also contact your instructor if you have difficulty interpreting the case.
You will briefly summarize the nursing issues and explore the legal outcome of your case. IMPORTANT: Do not get bogged down in the variety of other cases, or “case law” included to support legal arguments. Focus only on the details of what happened in the current case you are assigned. (See tips on how to identify what matters on the grading and guidance rubric linked above.)
Write your response in your own words. Copying legal jargon to describe events and issues will be penalized. As you respond remember all readers are nurses, so professional terminology should be used and a minute by minute review of medical events is not necessary since you can summarize what occurred from a nurse’s perspective.

Label your submission “DRAFT” if you do not want the copy graded. Clearly indicate in your title when you are submitting the “FINAL” copy for grading.
