Suggest possible remedies that may be available to the judges to overcome issues that may arise from implementing court decisions. Discuss two (2) overall strategies that a judge can utilize to implement decisions when verdicts are given by a jury. Provide a rationale for your response.
Part 2 (Respond to the post of a peer):
Peer’s Post:
“The three factors I think to permit the inferior court to implement decisions at their discretion are political pressure, local influencers, and public pressure. As lower court judges are not so power full as higher courts are so discretion also can also be due to higher courts. But political discretion is more common in all courts especially in lower courts and it really harms the way of small court’s working as well as decision making. The more factors that make discretion are gathering association, their philosophy, or their religious standards. What’s more, elucidation ought to tobe by somebody other than the strategy producer, a judge’s very own approach inclinations will likewise have an impact, and the way in which a lower court judge deciphers an arrangement built up by a higher court could affect choices. These variables could allow the execution of choices.
The executive branch of the govt could also be unable to implement court decisions because sometimes the difficulty could also be so complex that it’s difficult to urge a transparent policy. Like Terri said so many people and branches are involved it may be hard to work as an individual that’s why they all need to work as a team. Congress and The President may be involved and it can either be positive or negative. The impact creates more problems within the courts and there deciding. A solution would be stricter policies and standards. Or for the judges and executive branch to have certain rules or policies so they don’t step on each other’s feet.”
