You must assess if Patty Plaintiff has any legal claims as a result of a series of terrible circumstances in this assignment. After reading the scenario, respond to the following questions, making care to fully explain your conclusion.
Patty Plaintiff is at Cash Mart, her favorite store. She’s in the market for a new laptop but can’t seem to locate one she loves. Then, recognizing she’ll be late for an appointment, she tries to leave the store as quickly as she can. However, she is stopped by a security guard who accuses her of shoplifting before she can escape. Patty, who hasn’t taken anything, is adamant in her denial of any wrongdoing. Patty is taken to a little room in the back of the store by the police. Patty is told by the guard that if she tries to escape the room, she will be arrested and taken to jail. The security exits the room at this point. Patty is terrified, and she stays in the room for nearly an hour until the management apologizes and tells her she can leave.
Gerry Golfer is striking golf balls in his backyard at the same time. Gerry pulls out his new driver and hits a golf ball into the Cash Mart parking lot from his backyard. Patty Plaintiff is knocked out as she leaves the store when the golf ball hits her in the head.
Patty returns to work at Acme Corporation five days after recovering from her injuries. Unfortunately, although being aware that using corporate email for personal communication is against Acme’s company policy, she used it to send a personal email to her mother about her injuries. Patty’s supervisor, Barry Bossley, notices Patty’s infraction and reprimands her. When Patty gets home, she uses her personal computer to make derogatory comments on social media about her boss and Acme Corporation. Patty is sacked from her job the next day.
