When Jim and Laura arrive at the car dealership, they meet Stan Salesman. Stan shows them a variety of automobiles, and Jim and Laura get to test drive a few of them. The blue 4-door vehicle is a favorite of Jim and Laura. As a result, they agree to pay a $100.00 deposit to Stan Salesman to hold the automobile for a day. Stan Salesman refuses to give them a receipt, but assures them that the $100.00 will be refunded. There were no documents signed.
The next day, Stan Salesman contacts Jim and Laura to inquire about when they want to pick up the automobile. On their drive home from the showroom, Jim and Laura decided that they would not buy the car since they did not want to pay that much money each month. As a result, Jim and Laura inform Stan, the salesman, that they have decided not to purchase the car and would need their $100.00 deposit refunded.
Stan maintains that the $100.00 was a deposit on the car and was intended to be a part of the purchase agreement. Stan is adamant that Jim and Laura have signed a contract to buy the car; consequently, the $100.00 will be applied to the car’s purchase price. Jim and Laura are astonished and enraged, not just because they do not want to spend the money, but also because they believe Stan Salesman has misled them.
Jim and Laura have a lawyer appointment in a few days, but they know you’re a business law student and come to you for guidance.
