Second written assignment: Kyle wants to take Alabama Sunshine to the next level. Although his canned and dried vegetable lines are expanding, he wants to promote his new hot sauce, salsa, and condiment lines. Kyle sees the organically grown produce firm growing a strong, loyal customer base, but he wants to go beyond seasonal produce. Kyle’s Fantastic Condiments is the name he chooses after much thinking to establish an identity for his new products. Kyle believes it will stick on the plates and palates of his customers. Kyle has gotten his hot sauce, salsa, and condiment lines into United Nutrition Associates (UNA) grocery stores in Florence, Madison, and Huntsville, AL, as well as red and white billboards along I-20 in Tennessee and Alabama advertising his new products, as well as his new market in Jasper, AL, and his new company website (KFC.com). “KFC, your assurance of excellent farm fresh, family-focused, inexpensive food,” he says in radio and TV commercials for his new enterprise. Soon after, Kyle got a certified letter from Kentucky Fried Chicken (KFC), a well-known national chain restaurant, alleging injury to its business interests, including infringement and dilution of its trademark and trade name.
Undaunted, Kyle decided to start the forthcoming Thanksgiving holiday season by offering a special offer pack of his hot sauce, salsa, and condiments, dubbed the KFC Variety Pack, to spice up his profit margin and give customers a new taste. The variety packs are now available in all of UNA’s grocery stores, and they were so popular that they rapidly sold out. UNA now wants more of Kyle’s work. Candace B. Ritenoff, UNA’s chief financial officer (CFO), phones Kyle, promising to buy all of Alabama Sunshine’s KFC Variety Packs within the next 30 days and promising to send a $15,000 deposit to cement the sale. Unfortunately, Kyle was out of town, having decided to start the Christmas season early by relaxing and looking for fresh business chances in the Mobile Bay area. Kyle did not receive the offer until a week later, when he returned to Jasper, after the CFO had left it on his office voice mail. He quickly called Scooter, his production manager, and told him to increase value pack output by working the factory 24 hours a day, seven days a week, while guaranteeing Scooter a large bonus “if UNA’s needs are met.” Scooter relapsed to his old substance abuse habit as a result of the unexpected activity, promise of the bonus, and accompanying demands, necessitating his admission to an inpatient detox center in Savannah, TN, but not before he had gotten the plant’s new production schedule operational.
Kyle is concerned about the letter from the national restaurant chain, and he doesn’t want to engage into a long and expensive legal battle, so he seeks advice from you, his loyal college friend. Kyle claims that after informing his farm field production workers about the restaurant company’s cease and desist letter, some of them became enraged, fearing for their jobs, and threw overripe carrots and bell peppers at passing Kentucky Fried Chicken trucks, causing one of the drivers to crash into several utility poles. Kyle is also concerned that he will lose a lot of money because he has contracts with Slogan-Advantage Advertising for billboards and WLEO radio station for “on-air” advertisements. Kyle notes that he also has a contract with Intensified Tide Computer Services (ITCS) for the upkeep of the Alabama Sunshine/Fantastic Kyle’s Condiments website and inquires about the offer from UNA’s CFO and whether he will be obligated to pay Scooter the promised bonus.
