This term, the Supreme Court heard a case on whether a baker has the right to refuse to prepare a cake for a homosexual couple because of religious objections. The state of Colorado claims the baker’s acts are in violation of state anti-discrimination legislation, while the baker claims his conduct are protected under the first amendment.
The baker won in the end, although the decision was narrow in scope and did not set judicial precedent on the issues of discrimination and first amendment rights.
The moral correctness or sinfulness of gay marriage should not be the emphasis of your paper. It also shouldn’t focus on whether the baker’s refusal to serve the couple was morally justified or wicked, or whether the couple should have pursued legal action against the baker. We’re fascinated by the issue of legality and constitutionality. Is the law in Colorado unconstitutional? Were the baker’s acts constitutionally protected? Your position should address the issue of where the boundary between the first amendment and discrimination should be established.
Read the following article, do some independent research, and come up with a stance to support. ALL of your arguments and viewpoints should be backed up by verifiable proof from the outside world. Citing the first amendment’s wording, together with your view of what it means, is insufficient evidence. We have hundreds of years of case law and constitutional interpretation on our side. Keep an eye out for Federal Court decisions on similar constitutional disputes.
